ParkSpacely Terms and Conditions

Welcome to ParkSpacely. These terms and conditions ("Terms") govern your access to and use of the ParkSpacely website, app and related services.
By creating an account, making a reservation, specifying a parking space or otherwise using our services, you agree to be bound by these terms. If you do not agree, do not use ParkSpacely.
1. About ParkSpacely
ParkSpacely ApS is a Denmark-based digital platform that connects people and companies with unused parking spaces for motorists looking for convenient parking.
ParkSpacely acts solely as an intermediary. We do not own, operate, lease or control the parking spaces listed on the platform. The contract for the parking space is entered into between the parking space provider and the user, subject to the applicable reservation conditions.

3. Definitions
In these terms:
User means any person who searches for, books, pays for or uses a parking space through ParkSpacely.
Provider means any person or company that lists a parking space on ParkSpacely.
Booking means a reservation made through the Platform for a parking space for a specified period of time.
Services means all booking, payment, communication, support and related platform functions offered by ParkSpacely.
4. Our role as an intermediary
ParkSpacely provides the platform that enables users and providers to connect and enter into parking arrangements.
We do not guarantee the condition, legality, suitability, safety, availability or exact location of any parking space listed by a Provider. Providers are responsible for ensuring that the information they publish is accurate and up-to-date.
Responsibility for the physical parking space, access conditions, opening hours, local restrictions, signage and permits remains with the provider and/or the relevant property owner.
5. Eligibility and Account Registration
To use certain parts of ParkSpacely, you may need to create an account. You agree that all information you provide during registration and thereafter is true, accurate, current and complete.
You are responsible for maintaining the confidentiality of your login information and for all activity conducted through your account.
You must not:
create multiple accounts for the same person unless we allow it
impersonate another person
use false or misleading information
share your account information with others
use the Platform for illegal or fraudulent purposes
ParkSpacely may suspend or terminate an account if we reasonably believe that these Terms have been violated or if account activity creates a security, fraud or compliance concern.
6. Identity Verification and Compliance
ParkSpacely may request identity verification or other documentation where necessary for legal, regulatory, payment, prevention or dispute resolution purposes.
If you do not provide the requested verification information, we may limit, suspend or deny access to the Services.
7. Booking process
A reservation is only confirmed when ParkSpacely sends a confirmation or the reservation appears as confirmed in your account.
Users are responsible for checking all booking details carefully before confirming a booking. Providers are responsible for keeping listing information accurate, including pricing, access instructions, restrictions and availability.
8. Prices, Fees and Payments
The booking price and any service fees will be displayed before checkout. Payment must be made using the payment methods available on the platform.
ParkSpacely may use third party payment processors to handle transactions. By using the Platform, you agree that payments may be processed by such providers in accordance with their own terms and conditions.
9. Cancellations and refunds
Refunds are handled in accordance with the booking conditions set by the parking provider and the rules shown at the time of booking.
Users may be eligible for a refund if:
the reservation is canceled within the permitted cancellation period
the parking space is unavailable
the car park is significantly different from the given description
Service charges are non-refundable unless otherwise required by law or expressly stated in the booking conditions.
Where non-derogable consumer law gives a user the right to withdraw from a contract, these rights are not affected by these terms. Danish consumer guidance confirms that distance sales generally have a cancellation period of 14 days, although some services may fall under statutory exceptions depending on how the contract is structured.
10. User responsibility
Please provide accurate booking and vehicle details
park only during the reserved period
follow all entry instructions and site rules
respect local traffic laws and parking regulations
Make sure your vehicle fits the specified area and any specified restrictions
not obstruct other users, residents or operations
do not leave valuables or dangerous objects in the vehicle
11. Supplier's responsibility
only list parking spaces you have permission to offer
Keep your listing accurate and up to date
ensure that the car park can be used as described
clearly communicate access rules, restrictions and special circumstances
honor confirmed reservations unless cancellation is necessary for a valid reason
process any provider obligations in good faith through ParkSpacely
12. Prohibited use
You may not use ParkSpacely to:
break the law
submit false, misleading or fraudulent information
enter a parking space without proper authority
disrupt the operation of the platform
copy, scrape or misuse the platform's content or data
harass, threaten or abuse other users
attempt unauthorized access to any part of the Platform or the Systems
13. Availability and Technical Problems
We strive to keep the Platform available and functioning properly, but we do not guarantee uninterrupted or error-free access.
ParkSpacely is not responsible for delays, errors or interruptions caused by internet problems, payment processors, card providers, third party systems or events beyond our reasonable control.
14. Third Party Services
The Platform may depend on third-party services such as payment processing, mapping, messaging, verification and hosting providers.
Your use of third-party services may also be subject to their own terms and privacy policies. ParkSpacely is not responsible for the acts or omissions of third party service providers, except where required by applicable law.
15. Data protection and privacy
ParkSpacely collects and processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Danish data protection legislation.
We may process data such as:
account information
reservation details
payment-related data
communication records
verification data
technical usage data necessary to operate the platform
For more details, please read our privacy policy. The Norwegian Data Protection Authority states that data controllers are responsible for ensuring GDPR compliance, and data controllers/data processors must assess risks and implement appropriate technical and organizational security measures.
16. Intellectual Property
All content on the ParkSpacely Platform, including text, designs, graphics, software, logos and trademarks, is the property of ParkSpacely or its licensors, unless otherwise noted.
You may only use the Platform for its intended purpose. You may not copy, reproduce, modify, distribute or exploit any part of the Platform without our prior written consent, except where permitted by law.
17. Limitation of liability
To the maximum extent permitted by law, ParkSpacely is not responsible for:
the condition, legality, safety or availability of any parking space listed by a Provider
losses caused by inaccurate listing information provided by users or providers
parking fines, towing, damage to the vehicle, theft or loss resulting from the use of a parking space
indirect or consequential loss, including lost profits or business interruption
loss caused by events beyond our reasonable control
Nothing in these Terms shall limit liability where such limitation is not permitted under applicable law.
18. Suspension and Termination
We may suspend or terminate access to the Services immediately if:
you are violating these terms
we suspect fraud, abuse or illegal activity
your payment fails
required verification has not been completed
we are required to do so for legal or security reasons
You can stop using ParkSpacely at any time. Closing your account does not affect any rights or obligations that arose prior to closing.
19. Changes to these Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements or operational needs.
The updated version will be published on the website with a revised effective date. Your continued use of ParkSpacely after the updated terms become effective constitutes your acceptance of the revised terms.
20. Applicable Law and Disputes
These terms are subject to Danish law.
Any dispute arising out of or in connection with these Terms should first be raised with ParkSpacely Support so that we can attempt to resolve it informally.
If a dispute cannot be resolved informally, it can be brought before the competent Danish courts, unless mandatory consumer legislation provides otherwise.

Please note: ParkSpacely is a marketplace and intermediary. The parking contract is between the user and the parking provider. ParkSpacely is not the owner or operator of the listed parking spaces.
